Conviction

by rcs1

The one serious conviction that a man should have is that nothing is to be taken too seriously.
    Nicholas Butler1
    (1862 - 1947)
If life was as simple as that, what manner of people would we be? Would that permit us, then, to stand idle while others in need cry out for assistance, since we wouldn't take their pleas seriously? Or, perhaps, we should delve more deeply into the underlying definition of the word "conviction" -- are there perspectives and principles in play that would temper our understanding?

A man of conviction is not necessarily the same as a convicted man; the former stands by his principles, while the other is punished in accordance to the principles of others. A man - or men, and women - who claim to adhere to principles yet demonstrate no conviction to uphold them would, in my opinion, thus be the virtual embodiment of hypocrisy: theirs is the path of least resistance, where doing the "right thing" in accordance with principles common to humanity would require a greater degree of effort and - if you will -- conviction.

Below begins with a video clip from Judgement at Nuremberg, and below that an annotated transcript with links to illustrate just how far we've fallen as a nation of moral and legal obligation. It was sobering to compile. Please check every link and suggest new ones if you have any that are better.

Anyone who can create a YouTube or Flash embodiment that communicates the same thing is welcome to do so -- I think, hope and pray that it can be and is done, so that we can help take it viral and perhaps penetrate the veil of reluctance, recalcitrance and banality that has smothered our capacity to spur Congress into responsible, decisive action.

Excerpt of the Transcript2 and Video Clip from Judgement at Nuremberg

God bless the United States of America and this honorable tribunal.

The trial conducted before this tribunal began over eight months ago. The record of evidence is more than       pages long...and final arguments of counsel have been concluded.

Simple murders and atrocities do not constitute...the gravamen of the charges in this indictment.

Rather, the charge is that of conscious participation...in a nationwide, government-organized system...of cruelty and injustice...in violation of every moral and legal principle...known to all civilized nations.

The tribunal has carefully studied the record...and found therein...abundant evidence to support...beyond a reasonable doubt...the charges against these defendants.

Herr Rolfe...in his very skillful defense...has asserted that there are others...who must share the ultimate responsibility...for what happened here in Germany.

There is truth in this.

The real complaining party at the bar in this courtroom...is civilization.

But the tribunal does say...that the men in the dock are responsible for their actions.

Men who sat in black robes...in judgment on other men. Men who took part... in the enactment of laws and decrees...Unitary Executive theory the purpose of which was the extermination of human beings.Illegal war

Men who, in executive positionsOil company execs...actively participatedProsecutor Purge in the enforcement of these laws...illegal even under German law.

The principle...of criminal law in every civilized society...has this in common: Any person who sways another to commit murder...any person who furnishes...the lethal weapon for the purpose of the crime...any person who is an accessory to the crime...is guilty.

Herr Rolfe...further asserts that the defendant Janning...was an extraordinary jurist...and acted in what he thought was the best interest of his country.

There is truth in this also. Janning, to be sure...is a tragic figure. We believe he loathed the evil he did. But compassion for the present torture of his soul...must not beget forgetfulness...of the tortureAbu Graihb and the death of millionsIraq dead and displaced by the government of which he was a part.

Janning's record and his fate...illuminate the most shattering truth that has emerged from this trial. If he and all of the other defendants had been degraded perverts...if all of the leaders of the Third Reich...had been sadistic monsters and maniacs...then these events
would have no more moral significance...than an earthquake, or any otherCalifornia wildfires natural catastrophe.Katrina

But this trial has shown...that under a national crisis9-11...ordinary, even able and extraordinary men...can delude themselves into the commission of crimesIllegal, warrantless wiretapping...so vast and heinousWaterboarding, rendition that they beggar the imagination.

No one who has sat through the trial can ever forget them. Men sterilizedImmigrant denied medical care because of political belief.  A mockeryLimbaugh on Fox made of friendship and faith. The murder of children.cluster bombs

How easily it can happen.

There are those in our own countryRight-wing groups, too...who today speak of the protection of country...of survival.

A decision must be made in the life of every nation...at the very moment when the grasp of the enemy is at its throat. Then it seems that the only way to survive is to use the means of the enemy...to rest survival upon what is expedient,Patriot Act to look the other wayHypocrisy

The answer to that is: Survival as what?

A country isn't a rock. It's not an extension of one's self. It's what it stands for.

It's what it stands for when standing for something is the most difficult.

Before the people of the world...let it now be noted...that here in our decision, this is what we stand for: Justice...truth...and the value of a single human beingRogue Prosecutors.

It's fitting, in this age of rising gas prices, oil wars, energy behemoths, auto giants, global climate crises and illegal warfare to end with this rather interesting quote3 from the father of the modern automobile:

Don't find fault.  Find a remedy.  ~Henry Ford
Indeed.  In fact, I have a suggestion or four...:

Actually, I guess that's five, and that's just what I'd call "a good start."  Here's where it should end:

Update: Check out rba's excellent comment, below. It sums it all up nicely.

But witness how men with motives and a majority can manipulate law to cruel and unjust ends. Historian Alan Bullock writes that Hitler's dictatorship rested on the constitutional foundation of a single law, the Enabling Law.

Hitler needed a two-thirds vote to pass that law, and he cajoled his opposition in the Reichstag to support it. Bullock writes that ``Hitler was prepared to promise anything to get his bill through, with the appearances of legality preserved intact.'' And he succeeded.

Hitler's originality lay in his realization that effective revolutions, in modern conditions, are carried out with, and not against, the power of the State: the correct order of events was first to secure access to that power and then begin his revolution. Hitler never abandoned the cloak of legality; he recognized the enormous psychological value of having the law on his side. Instead, he turned the law inside out and made illegality legal.

Exactly what I think is happening here.

Thanks, rba!

There may be some left that don't appear to be directly related, but bear with me on 'em: for example, the oil execs who met as part of the Cheney Energy Task Force are alleged to have had a map indicating the distribution of Iraq oil fields among them, so it's in there. The one re: Limbaugh and Michael J. Fox is in there as a sole example of a pundit ridiculing others. There may be a reference of a pundit saying or doing something stupid that is a weak attempt at ridicule and ties directly to the war, but I couldn't find it. Lots of faux patriotic speech, but after a while I lost consciousness and had to be rescued...
